Although many people feel uncertain about what is often the first court appearance in a divorce case, this brief session serves to organize the upcoming months of litigation, clarify the issues in dispute, and set deadlines and expectations for the case’s progression. What Is a Case Management Conference?

A case management conference is a brief meeting between the Court, either a judge or a member of the court’s staff, and the spouses or their attorneys to preliminarily discuss the issues, discovery needs, and status of a divorce. This session allows the court to see which issues the parties have settled while identifying problems that still need a solution. Because the Court wants the case to move forward, this meeting establishes a formal timeline for all future legal steps.

Who Must Attend the Conference?

The Court’s Case Management Scheduling notice will specify if case management is for attorneys only or if parties are expected to also attend. Although the lawyers do most of the talking, having the parties present can help when the court needs a quick answer about undisputed procedural information, such as the date of marriage, the number and age of children, or whether there is a need for discovery specific to that case, such as the need for a pension appraisal or business valuation.   

What Are the Main Goals of This Conference?

The primary goal is to create a track for the case based on the nature of and the number of issues remaining in dispute. The court uses this time to decide what discovery will be needed, how much time to allot for the completion of discovery, and to ascertain whether the case necessitates services such as custody and parenting mediation through the court’s mediation program. Because every family is different, the court tailors the schedule to fit the specific needs of the situation.  

What Is a Case Management Order?

At the end of the meeting, the judge signs a document called a case management order. This paper lists specific deadlines for exchanging and attending custody and parenting time mediation, submitting proposed parenting plans and financial disclosures, exchanging financial records and written discovery, and completing any required appraisals/evaluations. Although it is a formal court order, its main job is to act as a calendar for the upcoming months.  

How Long Does the Conference Usually Last?

Most case management conferences are relatively short and often finish in less than 30 minutes. Because the focus is on procedure and scheduling, the conversation stays centered on logistics and timing. While the wait time in the in-person or virtual courtroom might vary, the actual interaction with the judge is usually direct and efficient.  

What Happens if a Spouse Misses a Deadline?

If someone ignores the dates set in the Order, the other side can ask the judge for a conference to help manage the progression of the case, or the compliant party can file a motion with the Court for relief. The court might dismiss pleadings, issue penalties, or require the person to pay for the extra legal work caused by the delay for more severe or repeated violations of the Case Management Order. The Court will often, in its discretion, allow some flexibility with procedural deadlines within reason. Because the schedule is a formal order of the Court, following the rules is the best way to keep the case on track.
